I may be wrong I often am as Mrs. Sipsi informs me, but I thought it illegal to hold an open market in any village or town without the access to a public convenience both for traders and visitors to the market due to public health issues

Public Toilets Closure
We no longer run or manage any Public Conveniences
The public toilets provided by North East Derbyshire District Council were closed from 1st April 2008. The Council managed nine public toilets in the district which cost tax payers £130,000 a year to run.
The decision to close the toilets follows a review of services provided by the Council which needed to make savings in order to balance the budget and avoid cuts to frontline services such as refuse collection, street cleansing and grounds maintenance
The above from NEDDC website

Well I suppose that there are "public" toilets in the Sports Centre, which is open when the market is on. Isnt that car park that is used by the market owned by NEDDCC (the toilets formed part of the development) so perhaps there is indeed an argument for the Parish Council to charge the NEDDCC for the facilities being provided in the Sports Centre when the market is being held – presummably someone gets an income from the market traders for the use of the car park.

I think your missing a point here. If I was going round the market and got caught short a walk to the leisure centre would'nt be the most helpfull thing to do, also I thought that if there was a public gathering that disabled toilets as well as normal toilets had to be provided. As for the parish council charging for the facilities is it not the parish council that has arranged the market, if so they should provide toilets.

Reading through the PC meetings this was raised immediately after they were closed the minutes say
"A resident raised concerns about the closure of the public toilet facilities in Killamarsh. A discussion took place.
Councillors explained to the resident he and others are welcome to use the facilities in the Sports Centre at any time and a member of the Council also advised that once Cafe Aroma is operational the public would be able to use the facilities there. In addition, the Methodist Chapel toilets are available currently Thursday mornings.
An explanation was given regarding the reasons for closure of the public toilets by North East Derbyshire County Council and it was explained that the Parish Coucil would look at the possibility of opening up the facility again in the future if the facility has not been removed in the meantime by the District Council and, subject to the Parish Council having the financial capacity to provide for this."
So take it that was a fob off as nothing further seems to have been done or mentioned in any subsequent meetings. Perhaps they should be reminded of this comment.
Wasn't another reason for the closure the requirements to comply with Disability Access laws that came into force in 2008?

This is the reply we have got from the parish council please read and draw your own conclusions thanks rroka
Dear RROKA
Thank you for your enquiry.
The public toilets situated at the Parkside Shopping Centre are owned by North East Derbyshire District Council. The District Council took a decision to close the facility some time ago and explained that this decision was taken after careful consideration given its challenging financial position. It therefore ceased to provide revenue support for this and some other similar facilities in the District and the toilets were closed.
The District Council did offer Parish Councils the opportunity for the public toilets to be transferred on a lease basis with full maintenance and repair obligations also being transferred to the Parish Council’s.
This matter was given careful consideration by Killamarsh Parish Council when setting its Budget regarding the facility at Parkside Shopping Centre but the Council decided that it could not provide the funding to take over the responsibility for the maintenance and repair of the building and the day to day cleaning required at that time.
I hope that I have fully answered your query but please contact me again if you require any further information on this matter.
Regards
Paul
