The pond at the bottom of long lane should bring some wildlife into the Dale.

I must admit we where very concerned when the pond construction started.  The trees cut down, stream altered, also we where told it was for the community.  We ask if it was going to be used for fishing, as we are concerned about parking, and where told no.  But we know there are fish in there, because the are been fed on a daily basis.  Also fishing platforms have been built.  Also the gate is pad locked, so its not for the community.

Very good point thanks. We did not know it was being stocked with fish as the water quality is not good enough for fish survival as it is full of Iron oxide (ocre water).

If this pond is being stocked with fish the owner neads a section 30 licence from the environment agency and be registered with CEFAS

(centre for environment, fisheries & aquaculture science) after the 1st of August 2009 the Environment Agency will no longer issue fish removal and fish introduction consents to an unregistered fishery. If you are unregistered and move fish onto or off of your fishery after the 1st August 2009 you will be breaching the regulations and breaking the law.

On the 27th of March 2009 there was a fundamental change in fish diseases legislation with the introduction of the Aquatic Animal Health (England & Wales) Regulations 2009.This required all stocked or cropped waters -excluding rivers and canals- to be registered with the Cefas Fish Health Inspectorate (FHI) The registration process has to be completed by 1st August 2009.

The regulations state it is an offence to operate an unregistered put and take fishery.A put and take fishery is described as a pond or installation where the population is maintained for recreational fishing by restocking.

The fishery operator must notify the FHI (Fish Health Inspectorate)in writing of any changes to ownership, waters, species present or if the fishery ceases operation within 90 days of the change.

Does anyone know if such documents are in order or does anyone know who owns the pond, the information at the bottom of a CEFAS registration form makes good reading “failure to comply with legal obligations may result in prosecution under the Aquatic Animal Health(England & Wales) Regulations 2009″.

Not sure who owns the land.  No planning permission with the council.  I know a gate has been put in place to the adjacent field.
